Terms and conditions
1. Scope. Validity.
These general conditions of sale apply to all sales contracts concluded by Nicola Faccin (CFFCCNCL75L17B564S) via G.Marconi 87, 35016, Piazzola sul Brenta (PD), via the website www.mypaura.com (hereinafter " Mypaura.com”)
Mypaura.com reserves the right to modify these conditions at any time and the modifications will be considered effective from the date of their publication on the Site.
Before confirming or forwarding the order, the Customer is required to carefully examine the general conditions of sale in force and to take ordinary care to understand them.
These General Conditions will be published on the Site in the current version; the Customer is required to view it when placing the order or accepting the service proposal.
No contract will be considered concluded until Mypaura.com confirms in writing (or by equivalent means) acceptance of the Customer's order. The purchase on mypaura.com.com implies acceptance of these Terms and Conditions and constitutes the buyer's declaration of being of age.
2. Definitions.
In these general conditions of sale it is intended:
“Seller” or “Mypaura.com” Nicola Faccin (CF FCCNCL75L17B564S) with headquarters in via G.Marconi 87, 35016, Piazzola sul Brenta (PD), contacts: info@mypaura.com .
– as “Customer” and/or “Consumer” the Customer, a natural person who makes purchases of products or commissions services for purposes unrelated to his/her entrepreneurial, commercial, artisanal or professional activity (and in this case the contracts concluded for the purchase of the Products or Services are governed by Legislative Decree 206/2005 “Consumer Code”);
– as a “Remote Customer” the Consumer who makes purchases from Mypaura.com online on the website www.mypaura.com (the “Site”) or with other remote means such as social networks;
– as “Products” and/or “Services” respectively the goods and services which are the object of the Mypaura.com commercial activity;
– “online sales contract”, means the purchase and sale contract relating to the Products of Mypaura.com or private individuals, stipulated between them and the Customer as part of a remote sales system using telematic tools, organized by Mypaura.com.
3. Pre-contractual information.
Before concluding the contract, the Customer is required to read these general contract conditions and the characteristics of the Products, illustrated in the appropriate sections published on the site or social network, or the methods of offering the Services provided by Mypaura.com.
In the case of a Customer having the status of Consumer, before the order becomes binding the Consumer will be duly informed regarding the following contractual elements:
The total price of the Products or Services including taxes, with details of shipping costs and any other additional or possible costs;
The payment methods, means and electronic circuits through which payments can be made;
the delivery methods and the deadline within which Mypaura.com undertakes to deliver the Products or provide the Services;
the conditions, terms and procedures for exercising the right of withdrawal, where applicable;
information that the Consumer will have to bear the cost of returning the goods in the event of withdrawal, where applicable;
information on the existence of the legal guarantee of conformity in favor of the Consumer for the Products purchased;
any post-sales assistance conditions and conventional guarantees offered by Mypaura.com.
The Customer may, before the conclusion of the contract, take note of the information relating to Mypaura.com published on the Site, including that relating to the geographical address, telephone number and e-mail address.
4. Conclusion of the contract.
By transmitting the order to Mypaura.com, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to have given consent to the purchase through the membership sent online after viewing a web page summary of the order, printable, which shows the details of the orderer and the order, the price of the goods purchased, the shipping costs and any additional additional charges, the payment methods and terms, the address where the goods will be delivered, the delivery times and the existence of the right of withdrawal, and that you have read, understood and fully accept these general conditions of sale. Only the order expressly accepted by Mypaura.com will be considered confirmed upon full payment of the price.
The contract between Mypaura.com and the Customer must therefore be considered concluded only when the Customer receives confirmation of the order received, via email to the address indicated by the Customer or also by other written means for orders sent outside the Site From that moment the order can no longer be modified.
The Customer undertakes to verify the correctness of the personal data contained in the above order confirmation and to promptly communicate to Mypaura.com any corrections/modifications to be made.
For goods not owned by Mypaura.com, for which it has received a mandate for sale from the owner, the sales contract is intended to be concluded exclusively between the owner of the goods and the Customer.
5. Description of the products.
Except as specifically indicated in relation to the different types of products in the descriptive sheets published on the Site, the characteristics and data resulting from photographs, drawings, illustrations, descriptions, reported in technical documents, in catalogues, on the Site and/or in any other documentation relating to the Products supplied are to be considered purely indicative, having exclusive illustrative purposes and not binding for Mypaura.com regarding the quality, quantity, performance or other characteristics of the products or services supplied to the Customer.
6. Delivery methods.
Except as indicated above in relation to the actual availability of the Products and unless otherwise indicated in the individual Product sheets, Mypaura.com undertakes towards the Consumer to deliver the Products within 30 days, it being understood that all the aforementioned terms will start from the confirmation of order to the Consumer.
The delivery terms of the Products are not intended as essential and Mypaura.com will not be liable for direct, indirect, incidental or consequential damages resulting from any delay in the delivery of the Products.
In the event of failure to comply with the agreed terms, it is the Customer's precise obligation to invite Mypaura.com in writing to deliver the Products within an additional period appropriate to the circumstances and, in any case, to carry out every necessary and/or useful action to take delivery of the Products, both as originally agreed and subsequently.
In the event of force majeure and/or any unforeseeable event beyond the reasonable control of Mypaura.com, the effective date of the terms will remain suspended from the day of the impediment.
The Products will be delivered with the shipping and transport methods chosen by Mypaura.com at its discretion, to the address indicated by the Customer at the time of the order. The contract with the Carrier will be concluded exclusively between it and the Customer remotely.
With delivery to the Carrier, Mypaura.com is no longer responsible for the integrity and conservation of the Products, the risk of which falls from that moment on to the Customer.
7. Prices.
All sales prices of the Products and provision of the Services offered on the Site are expressed in euros and include VAT, where applicable.
Prices are releases that can be determined and modified by Mypaura.com, however, the Products will be invoiced on the basis of the prices indicated on the Site at the time of transmission/creation of the order and reported in the order confirmation sent by Mypaura.com.
8. Payments for orders on the site.
For the Products ordered on the Site, any payment by the Customer can only be made using the methods indicated from time to time as available on the order form.
Payment must be made in advance and until then the completion of the contract is suspended.
The order confirmation from Mypaura.com will reach the Customer only once the total price has been paid, even in the case of payment by bank transfer.
In case of payment by bank transfer, the Customer must provide proof of the bank transfer order immediately and in any case within 2 days by sending a copy to Mypaura.com, via email to info@mypaura.com .
11. Right of withdrawal.
The Remote Customer has the right by law to withdraw from the purchase without any penalty and without specifying the reason, within 14 days starting, in the case of Product sales contracts, from the day on which the Remote Customer or a third , other than the Carrier and designated by the Remote Customer, acquires physical possession of the Products (or of the last Product delivered, in the case of multiple Products ordered by the Remote Customer through a single order and delivered separately, or of the last piece, in case of delivery of a Product consisting of multiple lots or pieces).
The Remote Customer who intends to exercise the right of withdrawal must communicate this to Mypaura.com via an explicit declaration, which can be sent by e-mail to info@mypaura.com
The communication of exercise of the right of withdrawal must contain, under penalty of inadmissibility of the request, the Customer's details, the Customer's contact details, the description of the Product and the order number as well as the delivery documents bearing the date of receipt of the shipping.
In case of exercising the right of withdrawal, the Remote Customer is required to return the Products within 14 days from the day on which he communicated to Mypaura.com his desire to withdraw from the contract pursuant to art. 57 of the Consumer Code. Shipping costs for returning the Products are borne by the Remote Customer. The shipment, until received by Mypaura.com, is under the responsibility and risk of the Remote Customer.
The Products must be returned to Mypaura.com at via Fratelli Cervi 30, 35016 Piazzola sul Brenta (PD).
The Products must be returned unused, intact, in the original packaging, complete in all their parts (including packaging and documentation and accessory equipment).
Upon receipt of the returned Products, Mypaura.com will verify their integrity. In the event of damage to the Product during transport, the Customer will be notified remotely of the incident, to allow him to act promptly against the Carrier he has chosen.
The right of withdrawal lapses in the event of a defect in the substantial integrity of the returned goods, and thus, by way of example but not limited to, in the case of:
use of the Product;
lack of external packaging and/or original internal packaging;
absence of integral elements of the Product;
damage to the Product;
anomalous state of conservation;
Customization (graphics, model, color);
Once the returned Products have been received within the aforementioned terms and their integrity has been verified, Mypaura.com will refund the Remote Customer the amount paid for the purchase of the returned Product.
The refund will take place within 30 days from the day on which Mypaura.com received the returned product and verified the existence of the conditions for the exercise of the right of withdrawal by the Consumer.
Art. 12 OPTIONAL TOOLS
We may provide you with access to third-party tools over which we do not monitor and have no control or management.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion. It is up to you to ensure that you are familiar with and agree to the terms and conditions to which any third-party tools are subject.
We may also offer new services and/or features through the Website in the future (for example, by introducing new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions of Service.
Art. 13 - THIRD PARTY LINKS
Some content, products and services available through our Service may include materials from third parties.
Third-party links on this site may direct you to external websites that are not affiliated with us. We are not responsible for examining or evaluating the contents or accuracy of such websites. And we make no warranty and have no liability for any third-party materials or websites or for any other materials, products, or services of third-parties.
We will not be liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made through any third-party websites. Please review the third party's policies and procedures carefully and make sure you understand them before engaging in any transaction. Complaints, requests, concerns and questions about third-party products should be directed to the applicable third-party.
Art. 14 WITHDRAWAL AND TERMINATION.
In compliance with the art. 52 of Legislative Decree 6 September 2005 n. 206 (the “Consumer Code”), you have the right to withdraw from the contract signed with Mypaura.com without any penalty and without having to provide any reason, within 14 days from the day on which you received the products purchased on Mypaura.com.com.
In compliance with the art. 54 of the Consumer Code, you can exercise the right of withdrawal by sending an explicit declaration of your decision to withdraw from the contract via email to Mypaura.com ( info@mypaura.com ).
In compliance with the art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to Mypaura.com your decision to withdraw from the contract.
In compliance with the art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or personalized products or sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery.
1. Necessary conditions for exercising the right of withdrawal
The right of withdrawal is considered exercised correctly if the following conditions are fully respected:
to. the right of withdrawal must be regularly exercised within 14 days of receipt of the products following one of the methods indicated above;
b. the returned products must not be different from those purchased and/or not belonging to the Mypaura.com catalogue;
c. the products must not have been purchased for resale purposes;
d. the products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in the art. 3, below, on the conformity checks of returned products;
And. the identification tag must still be attached to the products with the disposable seal which constitutes an integral part of the goods (see in this regard art. 5 below) if it was originally present;
f. the products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up) to the following address: via Fratelli Cervi 30, 35016 Piazzola sul Brenta (PD);
g. the returned products must be delivered to the courier within fourteen (14) days from when you communicated to Mypaura.com your decision to withdraw from the contract;
h. the products must not be damaged and must be returned unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if originally present), as well as their packaging, accessories and documentation.
If you have respected all the required conditions, Mypaura.com, in accordance with the art. 56 of the Consumer Code, will refund you in full the price of the products purchased, with only the return costs being your responsibility, i.e. those for returning the purchased products to Mypaura.com.
2. Refund times and methods
After Mypaura.com has received your return and checked that all the requirements have been met, you will receive an email confirming acceptance of the return and Mypaura.com will proceed with the full refund, or, if the existence of a decrease is found of value of the products returned pursuant to the previous paragraph, you will receive an e-mail in which you will be notified of the amount deducted as a reduction of the refund.

5. Products affected by defects or non-compliant
Without prejudice to the application of mandatory consumer protection regulations, you can return a product because it is defective or does not conform to what was ordered, by informing Mypaura.com within thirty (30) days from the day you received the products purchased on Mypaura. com, by email to the following address: info@mypaura.com .
Mypaura.com will check the products you have returned because they are affected by defects or do not conform to what you ordered and will proceed with a full refund, including shipping costs and the costs you incurred to return the products. In the event that Mypaura.com does not detect any defects or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you will be able to choose whether to receive the purchased products back. If you refuse the shipment, Mypaura.com will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.
Art. 15 APPLICABLE LAW
These Terms and Conditions of Service and any separate agreements under which we provide you the Services will be governed by and interpreted in accordance with Italian law, without application of the rules of reference.
